TERMS AND CONDITIONS OF SALE
1. GENERAL INFORMATION
In compliance with current regulations, particularly Law 34/2002 on Information Society Services (LSSI-CE) and Royal Legislative Decree 1/2007 approving the Revised Text of the General Law for the Defense of Consumers and Users (TRLGDCU), these Terms and Conditions regulate the contractual relationship between HEAVY ARTIFACTS (hereinafter, the Seller) and the User who makes a purchase through the website www.heavyartifacts.es (hereinafter, the Buyer).
2. CAPACITY TO CONTRACT
To make a purchase, the Buyer must be of legal age and have sufficient legal capacity. By completing the purchase process, the Buyer declares to meet these requirements.
3. PURCHASE PROCESS
The acquisition of products through the Website is carried out through the following process:
- Selección del producto y envío de solicitud de comisión.
- Confirmación por parte de HEAVY ARTIFACTS y emisión de presupuesto o cargo.
- Pago mediante los métodos habilitados.
- Confirmación de pedido por correo electrónico.
The sales contract is perfected when the Buyer receives order confirmation from HEAVY ARTIFACTS.
4. PRICES
All prices indicated on the Website include applicable VAT. The products sold by HEAVY ARTIFACTS are unique, numbered handcrafted pieces, subject to the reduced VAT rate of 10% in accordance with current Spanish tax regulations. HEAVY ARTIFACTS reserves the right to modify prices at any time, although changes will not affect already confirmed orders.
5. PAYMENT METHODS
Payments are made via a secure payment gateway (Stripe). HEAVY ARTIFACTS does not store the Buyer’s bank details.
6. INVOICING
The Buyer will receive an invoice or proof of purchase by email after order confirmation.
7. DATA PROTECTION
Personal data provided during the purchase process will be processed in accordance with the provisions of the Website’s Privacy Policy.
8. APPLICABLE LAW AND JURISDICTION
These Terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals corresponding to the Buyer’s domicile, in accordance with consumer and user regulations.
9. PRODUCT NATURE AND ARTISANAL VARIABILITY
All products offered on the Website are unique pieces made entirely by hand through artisanal processes. The Buyer expressly acknowledges and accepts that each piece is unique and will show variations from the images or descriptions published on the Website, derived from the manufacturing process itself. Such variations — in texture, tone, geometry, or finish — do not constitute a defect or grounds for complaint, but are an inherent and deliberate part of the artisanal character of the work.
10. CUSTOM PRODUCTION AND PAYMENT
All orders are produced on demand after payment confirmation. Payment is in full and prior to the start of production. The estimated production time is indicated on each product’s page. Once production has started, it is not possible to modify or cancel the order.
11. RIGHT OF WITHDRAWAL
In accordance with article 103.c of Royal Legislative Decree 1/2007 (TRLGDCU), the right of withdrawal is not applicable to goods manufactured according to consumer specifications or clearly personalized. As these are custom-made pieces, the Buyer expressly waives the exercise of this right from the moment the order is confirmed.
12. RETURNS AND CLAIMS
Returns are not accepted except in the following cases:
- La pieza llega dañada como consecuencia del transporte.
- La pieza no se corresponde con la referencia de producto adquirida.
In both cases, the Buyer must notify contact@heavyartifacts.com within a maximum of 48 hours of receipt, providing photographic documentation of the condition of the piece and packaging. No claims will be accepted after this period.
HEAVY ARTIFACTS will resolve each case by replacing the piece or fully refunding the amount paid, at its discretion.
13. SHIPPING AND DELIVERY
HEAVY ARTIFACTS ships to mainland Spain and Europe. Shipping costs are automatically calculated during the purchase process based on the destination zone.
Shipments to the Canary Islands, Ceuta, and Melilla are not available through the Website. If you wish to place an order for these destinations, please contact contact@heavyartifacts.com beforehand to arrange specific shipping conditions.
The delivery time consists of two phases: the production time, indicated on each product’s page, and the carrier’s transit time, which is added once the piece is ready for shipment. HEAVY ARTIFACTS is not responsible for delays attributable to the carrier or force majeure.
14. ONLINE DISPUTE RESOLUTION
In accordance with Regulation (EU) 524/2013, the Buyer is informed of the existence of the European online dispute resolution platform, accessible at ec.europa.eu/consumers/odr. HEAVY ARTIFACTS is not obliged to participate in alternative dispute resolution procedures, although the Buyer may use this platform to submit their claims.
